Thrill of Victory, Agony of Defeat by District 5 State Rep Dr. Doug Cox, Grove

Sometimes serving in the Legislature is a roller-coaster ride. It’s the thrill of having your ideas pass into legislation one minute and the disappointment of seeing some of your ideas defeated the next. I have had both experiences of late. Let’s look at the thrill of victory first.
Much has been made of concussions in athletes the last few years. While the long term effects of multiple concussions can be devastating with debility, they are Doug Cox5not fatal. Surprisingly, little has been said about sudden cardiac arrest (SCA), the most common cause of death in young athletes. On average, one student athlete dies of SCA every three days. We recently passed a bill to raise awareness of parents and coaches about this issue and make them aware that there are screening tests that can be performed to see if an athlete has any of the conditions that might make him susceptible for sudden cardiac arrest. With modern advances, most of these conditions are treatable or correctable and the person can continue to participate in athletics. The bill will make sure parents are given printed material that makes them aware of websites that discuss sudden cardiac arrest in athletes, and requires that coaches watch a seven minute video to raise their awareness as well. The Chase Morris Act, named after a Grove athlete who died of SCA, passed out of the House unanimously and is awaiting Senate approval of minor amendments before going to the governor for her signature.
We also passed a bill that directs physicians to check a computer program maintained by the Bureau of Narcotics and Dangerous Drugs the first time they prescribe certain medications that are sometimes addictive, abused or diverted, and then every six months if the patient continues this medication. The goal is to decrease Oklahoma’s prescription drug-abuse problem while still delivering compassionate care to patients.
I felt the agony of defeat when my bill was defeated that would have allowed formation of Tourism Improvement Districts (TID). A TID would allow like-minded businesses, such as restaurants, motels, marinas, etc., to join together, asses themselves a fee and use the money to market their area to increase tourism. If a majority of the businesses are in agreement, all of the businesses would contribute. With our state Department of Tourism having their budget cut 30 percent during the last few years, I felt this would give local communities a way to pool their resources to promote tourism and increase business. The bill was the brainchild of the Tulsa Chamber of Commerce, but I felt that rural areas could benefit as well. The concern for the businesses that did not want to participate, even though the majority did, was sufficient to defeat the bill soundly.

Second Chance Pet Rescue Grand Lake
Pets, like people, should be vaccinated to protect them from highly contagious and deadly diseases. On Saturday, April 18, Second Chance Pet Rescue of Grand Lake is hosting a Pet Vaccination Clinic which offers a variety of affordable preventative care vaccinations for the health and well-being of both dogs and cats. Spring Peak Bloom Time begins at Lendonwood Gardens, located at 1308 Har-Ber Road in Grove

The Angel of Hope statue stands among flowering trees and shrubs as the spring peak bloom time begins at Lendonwood Gardens. Lendonwood, located at 1308 Har-Ber Road in Grove, features large collections of azaleas, rhododendrons, dogwoods, hostas, peonies and many more. Admission is $5.00 per adult and $3.00 for students. Admission for children under 12 and for Lendonwood members is free.

Azaleas and rhododendrons are offering a splash of spring color right now at Lendonwood Gardens. Visitors are encouraged to come explore the eight-acre botanical garden in April and early May to enjoy the colorful shrubs and flowering trees.

        Located at 1308 Har-Ber Road in Grove, Oklahoma, Lendonwood contains large collections of azaleas, rhododendrons, dogwoods, hostas, Japanese maples, and ornamental cherry trees – springtime all-stars at the botanical garden.

        Admission to Lendonwood is $5 per adult and $3 for students.  All children under 12 and Lendonwood members are admitted free of charge.  Lendonwood is open year-round from dawn to dusk.  A non-profit organization, the botanical garden is supported with gate receipts, donations, memberships and volunteer labor.

        “People really shouldn’t miss this time of the year at Lendonwood,” said Jim Corbridge, president of the garden’s Board of Directors.  “We’ve enhanced the Azalea Garden just west of the garden fence, making that area more accessible to visitors.  Of course, it won’t be long before the rhododendrons begin to show their colors throughout the garden.”

        Rhododendrons have broad, leathery persistent leaves, while most azaleas have smaller and thinner leaves.  However, rhododendrons and azaleas are related plants and share many of the same characteristics.  Both like acidic soil and have shallow roots.  Plants range from low-growing to tall, treelike shrubs.

        Azalea and rhododendron flowers are generally cup- or funnel-shaped and appear singly or in clusters at the end of branches.  Bloom colors include white, pink, orange, red, mauve, and purple, among many others.

        In the Grove area, rhododendrons and azaleas can prosper if they are planted in rich, organic, well-drained soil protected by mulch.  Pine-needle mulch is especially helpful both for protection and acidic content.

Lendonwood Gardens is operated by a 16-member Board of Directors from the Grove area. Board members include Corbridge, Gary Daniels, Mardee Dodge, Roger Endo, Ray Geis, Pauline Hale, Rick Miller, Jane Montgomery, Marge Murphy, Michele Norwood, Cindy Reynolds, Jim Reynolds, Judy Scarriot, Ken Spragins, Larry Toigo and Dave Torline.

Senator Wyrick applauds new bill supporting OKPromise, education for Foster Care Children

A few months ago, I shared information about Oklahoma’s Promise and a bill under consideration in the Legislature that would encourage teens in foster care to enroll in the program.  Last week, Senate Bill 763 was signed into law, making it easier for older children in Oklahoma’s foster care program to access higher education or CareerTech programs.  The new law directs the Department of Human Services to work in conjunction with the Oklahoma State Regents for Higher Education to provide parents and legal guardians of foster youth with informative material and encourage higher participation in the state-funded scholarship program.

wyrick600Formerly known as Oklahoma Higher Learning Access Program (OHLAP), Oklahoma’s Promise provides educational opportunities for young adults who may not otherwise have access to higher education.  The cost of higher education is prohibitive for many, and is likely even more true for children who are in the state foster system. Many teens in foster homes may believe there is no way they would have the ability to pay for additional education, but with the provisions of the bill signed last week, we will be better equipped to inform these children and the adults in their lives about the “Oklahoma’s Promise” scholarship program.

By providing materials detailing how to apply for Oklahoma’s Promise, the hope is that we’ll not only have more students apply for the program, but it will also help foster care students, as well as their parents or guardians, better understand the value of the program and how they can maintain their eligibility.  With 242 foster care students currently enrolled in the program, it’s my hope we will see that number rise as the newly created network is connected between DHS and the Oklahoma State Regents for Higher Education.

This is an important step to provide parents and guardians better information to understand the value of Oklahoma’s Promise, as well as give Oklahoma foster children the tools to unlock a brighter future for themselves.

PAAS Vinita Grand Opening This Saturday!

It’s finally here! The Peaceful Animal Adoption Shelter will have their official Grand Opening this Saturday April 18th, 2015 at 10:30AM Everyone is welcome to attend and join the festivities.

 

Paas inviteCeremonies will include the official raising of the flag, a blessing over the building, special guest speakers from the community and PAAS board members then an update from PAAS Director Kay Stout. Volunteers’ will then lead attendees though a special tour of the new PAAS facility. The Grand Opening event will be held rain or shine, as special arrangements have been made in the event of inclement weather.  The facility will also be open on the 18th from noon until 5:00pm so people can tour.

 

After the Grand Opening Owner surrender animals will be accepted, by appointment only, beginning April 27th. All animals will be required to be in quarantine for a minimum of 10 days, and those of you bringing in animal surrenders will be able to keep the animals in your home during the quarantine time to allow us to serve more homeless cats and dogs. You can call 918-256-7227 for more information or to set up an appointment. When bringing animals in for owner surrender please note there are special entrances to use at the Shelter on the south side of the building.

 

The PAAS Facility will have normal open business hours Wednesday-Friday from noon to 5PM and Saturday 11 – 2. Once the animals have been through the 10 day quarantine, and are available for adoption you will be able to visit PAAS Vinita, or Search online through Petpoint, Petfinder, Adopt-a-pet, atwww.PaasVinita.com and we will update all of our social media outlets as well.

GRDA-The impact of the economic engine: part 1

The words “economic engine” have been associated with the Grand River Dam Authority for many years. It is fitting when you consider that GRDA’s low-cost, reliable power has been an attractive inducement for business and industry to locate in Oklahoma since the first megawatts of electricity were produced at Pensacola Dam. It is also fitting when you consider that the popularity of GRDA’s Grand Lake, created with the 1940 completion of the dam, continues to grow. Finally, it all fits when you consider that electricity, economic development and environmental awareness (caring for the resources under its control) are all central to the overall GRDA mission.

 

And to see exactly where it all fits, you can reference numbers like those found in a new study, commissioned by GRDA and conducted by the Oklahoma Department of Commerce. Released in March, this Economic Impact of the Grand River Dam Authority study takes a closer look at the impact GRDA’s operations, new construction and other positive externalities will have on the state in the years ahead.
According to the study, when focusing on the operational impact alone, GRDA’s economic impact in 2016 is projected to be:

  • $541 million in economic activity (output)
  • 2,870 jobs (supported by GRDA operations)
  • $150 million in real disposable income across the state

 

However, those are just the key figures from the report’s executive summary. There is much more information –looking further into the future and broken down into more detail — about GRDA’s impact on tourism, quality of life, and more. In the weeks ahead, this Power for Progress space will look at all this as it explores more about the GRDA “economic engine” and its operations in Oklahoma.

Headquartered in Vinita, GRDA is Oklahoma’s state-owned electric utility; fully funded by revenues from electric and water sales instead of taxes. At no cost to Oklahoma taxpayers, GRDA also manages 70,000 surface acres of lakes in the state, including Grand Lake, Lake Hudson and the W.R. Holway Reservoir. Today, GRDA’s 500 employees continue to produce the same “power for progress” that has benefited the state for 75 years. The efforts of Team GRDA facilitate over $450 million in economic activity in Oklahoma annually.

Smithsonian Traveling Exhibition Celebrating Sports In American Communities Coming to Miami

(Miami, OK) – Baseball.  Soccer.  Hockey.  Bowling.  Kickball.  Surfing.  People around the country are drawn to compete in these sports and many others.  Still more gather on the sidelines to cheer for their favorite athletes and teams.  Nowhere do Americans more intimately connect to sports than in their hometowns.  The Miami Public Library, in cooperation with the Oklahoma Humanities Council, will celebrate this connection as it hosts “Hometown Teams: How Sports Shape America,” a traveling exhibition from the Smithsonian’s Museum on Main Street program.  “Hometown Teams” will be on view April 24 through June 5.

Smithsonian Traveling Exhibition ItineraryThe Miami Public Library and the surrounding community has been expressly chosen by the Oklahoma Humanities Council to host “Hometown Teams” as part of the Museum on Main Street program – a national/state/local partnership to bring exhibitions and programs to rural cultural organizations.  The exhibition will tour six communities in Oklahoma from March 6 – December 11, 2015; an itinerary is attached, and a short video about the exhibition can be viewed at:

“Hometown Teams” will capture the stories that unfold on the neighborhood fields and courts, and the underdog heroics, larger-than-life legends, fierce rivalries and gut-wrenching defeats.  For more than 100 years, sports have reflected the trials and triumphs of the American experience and helped shape the national character.  Whether it is professional sports or those played on the collegiate or scholastic level, amateur sports or sports played by kids on the local playground, sports are everywhere in America.

“We are very pleased to be able to bring ‘Hometown Teams’ to our area,” said Marcia Johnson, Library Director.  “It allows us the opportunity to explore this fascinating aspect of our own region’s sports history and we hope that it will inspire many to become even more involved in the cultural life of our community.”

“Allowing all of our state’s residents to have access to the cultural resources of our nation’s premier museum is a priority of the Oklahoma Humanities Council,” said Ann Thompson, OHC Executive Director.  “With this special tour, we are pleased to be working with the Miami Public Library and the community of Miami to help develop local exhibitions and public programs to compliment the Smithsonian exhibition.”

Museum on Main Street invites the public to share their local sports stories through the “Stories from Main Street” website at www.storiesfrommainstreet.org or through the free mobile app available from the Mac App Store or the Google Play Store.  Both platforms record and map the location reflected in the submission and will accept written and audio stories as well as videos and photos.  Selected submitted stories to “Stories from Main Street” will be featured on the website and app.  The archived stories will serve as a searchable record of the unique experiences of life in American small towns.  Each story can be searched via location or by topic.

GRDA: The impact of the economic engine: part 2

In the new Economic Impact Study of the Grand River Dam Authority, there are plenty of numbers to consider. Numbers related to things like GRDA’s overall operations, new construction and investments, tourism and quality of life contributions and more.

Generating jobs … Construction trailers, equipment and plenty of activity surround the Grand River Dam Authority’s Grand River Energy Center (then known as the Coal Fired Complex) during the construction of Unit 2 in the early 1980s. Similar to that project, GRDA’s current construction of Unit 3 (being built today in a location near the left side of this photo) will support hundreds of construction jobs on the site during 2015 and 2016.

Commissioned by GRDA, the study was prepared by the Oklahoma Department of Commerce and is actually an update of the same type of study first completed in 2012. In the years since those first numbers were released, many new projects and decisions have been made around GRDA, all with an impact on the economic bottom line. At the top of that list is GRDA’s new Unit 3 combined cycle generation plant.

Of course, while the dollars detailed in the study are important, so are the jobs, which generate dollars for Oklahomans. According to the latest numbers, GRDA’s investments, quality of life enhancements and low power costs will all combine to support 7,100 jobs in the Oklahoma economy in the 2015 – 2016 two-year span, which is the time that much of the construction work will take place on Unit 3. After the temporary job boom during construction, employment numbers are expected to taper off, though GRDA’s operations and existence are still expected to support a conservative estimate of 2,700 jobs in the state’s economy through 2020. Meanwhile, Unit 3 represents a $400 million investment in Oklahoma that will provide the low-cost, reliable power to support more and more Oklahoma jobs and industries for many years to come. In other words, this important Oklahoma economic engine is ready to keep on running.

Legislator Calls for Moratorium on Oil/Gas Disposal Wells In ‘Areas of Interest’ Where ‘Quakes Are Occurring

Cory WilliamsOKLAHOMA CITY – State Rep. Cory Williams, D-Stillwater, called Tuesday for a moratorium on oil and gas wastewater disposal wells in the 16 counties the Oklahoma Corporation Commission has identified as “areas of interest” because of earthquake activity.

            State Seismologist Austin Holland of the Oklahoma Geological Survey (OGS) announced Monday that saltwater disposal wells quite likely triggered most of the earthquakes that have occurred in central and northern Oklahoma over the past two and a half years.

            “Based on observed seismicity rates and geographical trends following major oil and gas plays with large amounts of produced water, the rates and trends in seismicity are very unlikely to represent a naturally occurring process,” the OGS wrote in a statement issued Tuesday.

            The Corporation Commission, which regulates the oil and gas industry, Gov. Mary Fallin and major oil producers in Oklahoma “have consistently said they would re-evaluate this issue if scientific evidence demonstrated that there was a connection between disposal wells and earthquakes,” Williams said. “Well, the science on induced seismicity is in. It’s time to take swift action to protect the lives and property of this state’s citizens.”

            Approximately 4,500 Class II wastewater disposal wells have been drilled in this state, and about 3,200 of them “are injecting at any given time,” Corporation Commission spokesman Matt Skinner said Tuesday.

            Initially the commission zeroed in on saltwater disposal wells in eight counties where earthquakes have occurred at a high frequency: Alfalfa, Garfield, Noble, Payne, Lincoln, Oklahoma, and especially Grant and Logan counties.

            The number of disposal wells in those 16 counties totals “more than 1,000,” Skinner said.

            The seismicity rate in Oklahoma in 2013 was 70 times greater “than the background seismicity rate observed in Oklahoma prior to 2008,” the OGS wrote in its report. “While unlikely, this rate could have been potentially explained by natural variations in earthquake rates from naturally occurring swarms.”

            Now, though, the seismicity rate is “about 600 times greater than the background seismicity rate and is very unlikely the result of a natural process,” the OGS reported.

            Historically the Oklahoma Geological Survey recorded on average about 1½ earthquakes each year in Oklahoma that were gauged at Magnitude-3 or greater.

            In 2013 the OGS logged on average about two Magnitude-3+ earthquakes each week and this rate continued to rise during 2014, to a year-end total of 580 Magnitude-3+, or almost 1.6 per day, according to the OGS. “Currently the OGS is reporting on average about 2½ M3+ earthquakes each day,” the agency said.

            The Oklahoma Geological Survey deems it “very likely” that the majority of recent earthquakes, particularly those in central and north-central Oklahoma, “are triggered by the injection of produced water in disposal wells.”

            The primary suspected source of triggered seismicity “is not from hydraulic fracturing, but from the injection/disposal of water associated with oil and gas production,” the OGS added.

            The Corporation Commission’s Oil and Gas Conservation Division (OGCD) issued directives last month to disposal well operators that are injecting into the Arbuckle formation in the “areas of interest” in the 16 affected counties. Those operators were given a deadline of April 18 to prove to the OGCD that their disposal wells were not extending below the Arbuckle formation.

            The Arbuckle is “the favorite disposal zone” for oil and gas producers – approximately 900 disposal wells inject into the Arbuckle – and lays just above “basement” rock, Skinner said.

            “There is broad agreement among seismologists that injecting below the Arbuckle poses a potential risk of causing earthquakes, as it puts the well in communication with the solid ‘basement’ rock,” the commission wrote in a media advisory last month.

            Seven disposal wells injecting into the Arbuckle “have been identified as too deep and will have to be plugged back,” Skinner said Tuesday. Any operators who cannot show that their disposal wells do not extend below the Arbuckle and who don’t have an approved well-plugging plan will be required to reduce their disposal volumes by 50%, the Corporation Commission has mandated.

            “There will no doubt be more steps to take, and all options available to the Commission are on the table,” the agency claims on its website. “There is no issue that has a higher priority for this agency, and the continuing work and commitment of OGS is central to this effort,” the OCC concluded.

            Meanwhile, the U.S. Geological Survey recently issued a preliminary Oklahoma seismic hazard map for 2015 that includes a colored zone that identifies 10 counties in central and north central Oklahoma that have experienced a high frequency of M-3+ earthquakes since 2010. The final version of that map will be issued in coming months.

            The seismic hazard map is a guide that’s utilized by mortgage and homeowners insurance companies to establish insurance rates based on earthquake risk; by home loan lenders; and to establish building codes.

            “There is no greater action this Legislature or the Corporation Commission could take to preserve lives and property than a moratorium on injection wells in the 16-county area,” Williams said. “Failure to act is tantamount to complicity.”

Senate Minutes by Senator Charles Wyrick, child abuse and neglect in Oklahoma

April is Child Abuse Prevention Month and this week, lawmakers and others from around the state gathered at the Capitol to raise awareness of child abuse and neglect in Oklahoma. Flags were placed on the south side of the building to represent the 60 children who died from abuse in 2014 in Oklahoma.
Child abuse and neglect statistics are rising in Oklahoma. Research shows that in addition to having a significant impact on children’s health and well-being, abuse and neglect have also been linked to poor educational and cognitive development, physical aggression, teenage pregnancy, substance abuse, juvenile or adult criminal behavior and other associated impairments later in life. It’s no surprise the direct cost to society of child maltreatment is estimated to be well over $9 billion annually when accounting for public assistance, child protection, criminal justice, and behavioral health and education systems at the local, state and federal levels.
wyrick small In the four counties that comprise Senate District 1, there were 361 substantiated cases of child abuse or neglect in 2013. Statewide, there were over 65,000 families reported to the Department of Human Services and in 11,418 cases, the allegations were found to be substantiated. These numbers are concerning when you consider 12.2 children out of every 1,000 in the state are being subjected to abuse and neglect in some form.
The most notable risk factors for children are age, race and disabilities. Many studies show that the younger a child is, the greater the risk for maltreatment. Children with physical, cognitive or emotional disabilities also are abused at higher rates. Multiple factors contribute to those who abuse or neglect children, including age and education level of the parent or caregiver, as well as substance abuse habits and mental illness history. Marital conflict and domestic violence in the home also play a significant role in abuse cases. The family structure, parental histories and the generational cycles of abuse are all contributing factors to the risk of abuse and neglect in Oklahoma.
According to the Oklahoma State Department of Health, parents or guardians who exhibit certain protective factors that work together are at lower risk of inflicting abuse or neglect.

GRDA Power for Progress: economic engine: part 3

In this third installment regarding the new Economic Impact Study of the Grand River Dam Authority, commissioned by GRDA and prepared by the Oklahoma Department of Commerce, the focus is on population.

When construction began on Pensacola Dam in 1938, thousands of people flocked to the region, looking for work. Over the next two years, those people helped to build one of the state’s grandest structures, which also served to create the 46,500 surface acres of lake waters that comprise Grand Lake. By the fall of 1940, the lake was mostly full and suddenly, a region that had been rugged and rural, was now home to what would become the state’s premier water recreation destination. And close by, the dam was creating abundant electricity to help fuel growth in the area and draw even more people to live, work and play in the lakes region.

According to the study, “in the 10 years after the Pensacola Dam was finished in 1940, the region’s population grew 8.2% compared to the 5.0% decline experienced by Oklahoma’s non-metro counties over the same period. Over a longer period of time (1940 – 2010), the region around Grand Lake and Lake Hudson posted a 33% population growth rate. Comparatively, Oklahoma’s non-metro counties experienced virtually no population growth.”

Of course, population growth translates into economic development and a broad tax base that supports the services and infrastructure that allows those residents to live, work and play near the waters of GRDA lakes. Not only were the waters of the Grand River harnessed to make electricity in 1940, but they were also harnessed to help transform a large region of Oklahoma, while also providing benefits statewide.

It was a busy week at the state Capitol. Despite the hectic pace, I enjoyed having Jacob Ross and Damon Grayson from Grove and Teisha Carnes from Salina serve as pages.  Jacob was selected by his peers as “Page of the Week!” They all did a great job and participated in their own Page Legislative Session to further learn about the legislative process.Cox’s Corner, Cox’s Page elected Page of the Week!

I voted for a bill to ban powdered alcohol in Oklahoma. This is a substance without any positive uses not already fulfilled by liquid alcohol. It is prone to be used in vaping (electronic cigarettes) and could easily be dissolved – knowingly or unknowingly – in someone’s drink. Most states will ban the substance.

   While I certainly agree with a clergy’s right to refuse to marry people, I voted against a bill to put that in statute. I just do not see it as a being a big problem. If I am a gay couple, I am probably not going to ask the Southern Baptist preacher to marry me. My African-American legislative colleagues had some concerns that it could be applied to racially-mixed marriages. I just did not want to lengthen the law book with what I felt was primarily a solution in search of a problem.

   A bill to increase the penalty for assaulting an off-duty law enforcement officer, as well as one to eliminate the current age limit of 45 for new volunteer firefighters, did receive my “yes” votes.

   I personally authored and passed bills to prevent people from hiding financial assets in prepaid burial funds while getting the taxpayer to pay their medical expenses, as well as a bill modernizing the state Dental Act, which was this act’s first major revision in 40 years. Not earth-shattering issues, but an example of the day-to-day work we do at the Legislature.

   We have completed all of the House and Senate bills. We now will be working out details and re-voting on bills where the House versions differ from the Senate versions, as well as finalizing the state budget.

Governor signs Native American juvenile justice measure

House Bill 1834, introduced by Rep. Seneca Scott, D-Tulsa, and sponsored in the Senate by Sen. A.J. Griffin, R-Guthrie, passed through both chambers of the Legislature last month, unopposed, and was transmitted to the governor on April 30 for her consideration. She signed the bill on May 6 and it goes into effect Nov. 1 of this year. Governor signs Native American juvenile justice measure

SENATE OK                HB 1834 was initially approved by the Oklahoma House of Representatives on March 9, by a vote of 93-1.

                After its approval by the House, HB 1834 then moved over to the Senate, where it was assigned to the Judiciary Committee. That committee passed the bill 9-0 after amending the measure by “striking the title”. That was a procedural, parliamentary action indicating the measure would be sent to a joint House/Senate committee that would resolve differences; no bill introduced in the Oklahoma Legislature can become law without a title and an enacting clause.

                Instead, the bill was amended in the Senate by a floor substitute, which passed the Senate, 44-0, on April 20. The bill returned to the House of Representatives for reconsideration of the revised measure. The House accepted the Senate’s amended version and passed the bill without dissent on an 81-0 vote April 29. The next day the legislation was sent to the governor.

                The final, mutually accepted, enacted version of the bill decrees that whenever a child is taken into custody, an employee of the state Office of Juvenile Affairs or a county juvenile bureau “shall inquire as to whether there is any American Indian lineage or ancestry that would make the child eligible for membership or citizenship in a federally recognized American Indian tribe or nation.” If it is determined that the child may have American Indian lineage or ancestry, the employee of the Office of Juvenile Affairs or county juvenile bureau “shall notify the primary tribe or nation of membership or citizenship” within “three judicial days” [instead of “72 hours” in the version originally approved by the House] after completion of the intake.

                (The rationale behind the legislation is to involve tribal officials in juvenile matters sooner rather than later. Also, the Disproportionate Minority Contact [DMC] initiative administered by the OJA could steer minors away from the juvenile justice system via a state/tribal partnership starting with notification or improving communication, with an emphasis on prevention rather than punishment. The purpose of the DMC Core Requirement is “to ensure equal and fair treatment for every youth in the juvenile justice system, regardless of race and ethnicity. This tribal/state partnership includes the co-chair of the NAJJTF task force, with Representative Dode Barnett from the Creek Nation.)

                An interim legislative study on the DMC was held in October 2014, and that started steps for decreasing the number of these children in the system. In addition, a tribal partnership was established and was formalized in January with the Inter Tribal Council creating a tribal-appointed Native American Juvenile Justice Task Force; all five eastern tribes (Creek, Seminole, Choctaw, Cherokee and Chickasaw) have named their appointees who will work with OJA, extending from notification efforts to diversion strategies. Meanwhile, efforts are being expanded to invite all 34 other federally recognized tribes into the juvenile diversion effort.
